Expungement & Expunction: What Texas Law Actually Does to a Record

Texas law uses the term expunction. Expungement is the term most people search for, and the two refer to the same process in practice. Under Chapter 55A of the Texas Code of Criminal Procedure, a granted expunction petition results in a court order directing every agency holding records of that arrest to destroy or return those records and remove all electronic references. After expunction, a person may legally deny the arrest occurred in most contexts, and it won’t appear on standard background checks run by employers, landlords, or lenders.

A separate process, the order of nondisclosure, seals records from public view rather than destroying them. Law enforcement agencies and certain professional licensing boards can still access sealed records, and nondisclosure doesn’t allow a person to deny the arrest in a later criminal proceeding. Nondisclosure is a meaningful option when expunction isn’t available, but the two remedies produce different outcomes. Knowing which one applies to a given situation is the first thing we determine.

Who Qualifies for Expunction in Texas

Eligibility under Chapter 55A is based on case outcome, not offense type. The qualifying scenarios include:

  • Acquittal at trial: A jury or judge found you not guilty
  • Charges dismissed: The case was dismissed and the applicable statute of limitations has expired
  • Charges never filed: The applicable waiting period has passed without charges being brought
  • Pardon: A conviction was later pardoned by the governor or president
  • Identity theft: Someone was arrested using your identifying information without your consent

Several conditions disqualify a petition even when one of those scenarios applies. A person convicted of any felony within the five years before the arrest sought for expunction doesn’t qualify. Cases resolved through community supervision (probation) don’t qualify, with the exception of certain Class C misdemeanors. Family violence cases and sex offenses requiring registration are also disqualifying.

Deferred adjudication for a Class B misdemeanor or higher doesn’t qualify for expunction, though it may qualify for nondisclosure. Waiting periods apply before a petition can be filed: 180 days for Class C misdemeanors, one year for Class A and B misdemeanors, and three years for felony arrests where no conviction resulted.

The Expunction Process in Hidalgo County

Filing for expunction in Hidalgo County means filing a Petition for Expunction in civil district court in the county where the arrest occurred. The petition receives a civil case number and a hearing is scheduled no sooner than 30 days after filing. Every agency holding records tied to the arrest, including law enforcement, the district attorney’s office, and other record-holding entities, must be served with the petition and notified of the hearing date.

If the court grants the petition, it issues an order directing each named agency to destroy or return its records and remove all electronic references to the arrest. A petition filed incorrectly or missing a required procedural step can be delayed or denied entirely. The Hidalgo County District Attorney’s office publicly recommends consulting a private attorney before filing. Identity theft victims who had someone arrested using their information may also pursue expunction under this process. From filing to final resolution, the process in Hidalgo County typically takes six to eight months.

What Changes After a Successful Expunction

Once an expunction order is issued, the practical effects are significant. Employment applications, rental screenings, professional license reviews, and credit decisions that previously surfaced the arrest may no longer do so. A person may also legally state they were not arrested or convicted for that offense in most contexts, a right that doesn’t exist under nondisclosure.

For clients clearing a DWI or DUI arrest where eligible, or removing an old charge that has blocked professional advancement, the difference between having and not having that record can be concrete and immediate. Nondisclosure removes the record from public-facing databases, which matters in many situations, but it doesn’t allow a full legal denial the way expunction does.
