What Texas Law Treats as Prescription Fraud
Texas Health and Safety Code Section 481.129(a-1) addresses obtaining or attempting to obtain a controlled substance, or a prescription for one, that isn’t medically necessary through misrepresentation, fraud, forgery, deception, subterfuge, or concealment of a material fact. A material fact can include whether the person already has a prescription for the same controlled substance from another practitioner covering the same period.
An unusual prescription history doesn’t establish every element of the offense by itself. The State’s theory may concern a document, information given to a practitioner or pharmacy, a person’s identity, or disclosures about other prescriptions.
Allegations commonly described as prescription fraud may involve:
- A forged prescription or unauthorized prescription form
- Changes to the medication, quantity, dosage, or refill information
- Use of a prescription issued to another person
- False information allegedly provided to a medical practitioner or pharmacy
- Prescriptions obtained from multiple providers without disclosure of relevant information
