Expungement vs. Expunction: What Texas Law Actually Does

Texas law uses the term expunction, though most people search for expungement. They mean the same thing in practice. Under Chapter 55A of the Texas Code of Criminal Procedure, a successful expunction results in agencies being ordered to destroy or return all records tied to the arrest. After that, you may legally deny the arrest occurred in most contexts, and it won’t appear on standard background checks conducted by employers, landlords, or lenders.

A separate process, the order of nondisclosure, seals records from public view rather than destroying them. Law enforcement agencies and certain licensing boards can still access sealed records, and nondisclosure doesn’t allow you to deny the arrest in a subsequent criminal proceeding. It’s a meaningful option when expunction isn’t available, but it’s not the same result.

Who Qualifies for Expunction in Texas

Eligibility is specific. Under Chapter 55A, you may qualify if you were acquitted at trial, the charges were dismissed and the statute of limitations has expired, charges were never filed and the applicable waiting period has passed, or your conviction was later pardoned by the governor or president. An arrest resulting from identity theft can also be expunged.

Several situations disqualify a person from expunction. If you were convicted of any felony within the five years before the arrest you’re seeking to expunge, you aren’t eligible. Cases resolved through community supervision (probation), family violence cases, and sex offenses requiring registration are also ineligible. Deferred adjudication for a Class B misdemeanor or above doesn’t qualify for expunction, though it may qualify for nondisclosure.

Waiting periods apply before a petition can be filed. For Class C misdemeanors, the wait is 180 days. For felonies, you generally must wait until the statute of limitations has expired, which can be three or more years. The Expungement Process in Hidalgo County

Filing for expunction in Hidalgo County means filing a Petition for Expunction in civil district court in the county where the arrest occurred. The petition receives a civil case number, and a hearing is set no sooner than 30 days after filing. Every agency holding records of the arrest, including law enforcement, the district attorney’s office, and other record-holding entities, must be served with the petition and notified of the hearing date.

If the court grants the petition, it issues an order directing each agency to destroy or return its records and remove all electronic references to the arrest. The Hidalgo County District Attorney’s office itself recommends that anyone pursuing expunction consult a private attorney before filing. That recommendation exists for a reason. A petition filed incorrectly or missing procedural steps can be delayed or denied. From filing to resolution, the process in Hidalgo County typically takes six to eight months.

What Clearing Your Record Can Change

A criminal record visible on background checks can block job applications, apartment rentals, professional license approvals, and credit decisions. After a successful expunction, you may legally state you weren’t arrested or convicted for that offense in most contexts, and the legal barrier the record created may be removed. Nondisclosure doesn’t reach that same result, but it does remove the record from public-facing databases, which matters in many practical situations.
