Theft Charges We Handle in San Antonio
The charge filed depends on the alleged conduct, the property involved, and the facts the State claims it can prove.
We handle allegations involving:
- Misdemeanor theft involving retail merchandise, personal property, or vehicles
- Felony theft
- Shoplifting
- Firearm theft and other allegations involving weapons
- Robbery
- Burglary
- Fraud and white-collar theft involving financial transactions
- The purchase or sale of property believed to have been stolen
Robbery and burglary are separate offenses with legal elements that differ from theft. We examine the charge actually filed rather than treating every property-related accusation as the same type of case.
Allegations involving stolen goods require close attention to the transaction, the accused person’s knowledge and intent, and the evidence connecting that person to the property.
How Texas Classifies Theft Under Penal Code § 31.03
Texas Penal Code § 31.03(e) uses property-value grading, so the alleged value generally determines whether theft is classified as a misdemeanor or felony. The current statutory thresholds are:
Misdemeanor theft classifications:
- Under $100: Class C misdemeanor.
- $100 to under $750: Class B misdemeanor.
- $750 to under $2,500: Class A misdemeanor.
Felony theft classifications:
- $2,500 to under $30,000: State jail felony.
- $30,000 to under $150,000: Third-degree felony.
- $150,000 to under $300,000: Second-degree felony.
- $300,000 or more: First-degree felony.
Value isn’t the only factor that can determine classification. Theft of a firearm, property taken from another person, or property taken from a human corpse or grave is a state jail felony regardless of the alleged value. Theft of a driver’s license or state identification card is a Class B misdemeanor regardless of value.
As of September 1, 2025, stealing copper or brass from a critical infrastructure facility raises the punishment to the next higher category. The same enhancement applies to equipment or communication wires connected to such a facility. Identifying the property type and statutory category is therefore an important part of reviewing the accusation.
Evidence That Can Affect a Theft Case
The outcome of a theft accusation can turn on disputed facts and whether the State can establish each element of the charged offense.
Our review may address several issues:
- Identity: Surveillance footage, witness observations, and incomplete identification evidence may raise questions about who was involved.
- Consent: Permission to possess, use, or take property may be central to the allegation.
- Property value: The State needs evidence supporting the alleged value because it affects the charge classification.
- Intent: Communications, witness accounts, property records, and the surrounding conduct may bear on whether the accused intended to deprive the owner of the property.
Rene Flores holds ACS-CHAL Forensic Lawyer-Scientist certification, a credential involving the application of scientific methods to legal evidence. This training allows him to examine the State’s scientific evidence closely when forensic material plays a role in the accusation.
We use the available evidence to assess which elements the State must establish and determine an appropriate defense strategy for the specific case.
What a Free Criminal Defense Consultation Covers
A free initial consultation gives us an opportunity to discuss the allegation, immediate concerns, and available legal representation. The next steps can depend on the charge, the court handling it, any bond conditions, and the case’s current procedural posture.
The Bexar County Courthouse and Municipal Court may process theft cases arising from a San Antonio arrest, although routing and timing depend on the classification and circumstances of the charge.
Rene Flores remains directly involved rather than rotating cases between attorneys or handing clients to junior staff. We provide clear guidance and respond promptly to calls and messages.
