Under Texas Penal Code Section 49.01, intoxication can be established by the influence of a controlled substance, a dangerous drug, a combination of substances, or any other substance introduced into the body. There is no legal concentration limit for drugs. Instead, prosecutors must prove the driver lost the normal use of mental or physical faculties, a subjective standard that relies on officer observations, field sobriety test performance, and blood toxicology results. Under Texas Penal Code Section 49.10, a lawful right to use the substance, including a valid prescription, is not a defense.
When officers suspect drug impairment rather than alcohol, they typically seek a blood sample rather than a breath test. That sample is analyzed for controlled substances, often through gas chromatography. In Hidalgo County, blood samples are sent to the Texas DPS Crime Laboratory in Weslaco. Officers may also employ the 12-step Drug Recognition Expert (DRE) protocol at the roadside to document their basis for believing a driver was drug-impaired.
